Chapter 1 General Rules

Article 1 (Purpose)

These terms of service are designed to provide for basic matters concerning the terms and procedures for using the Shilla online server services (“services” hereinafter) provided by The Shilla Hotel (“the hotel” hereinafter).

Article 2 (Validity of an amendment to terms)

(1) These terms go into force when they are published by displaying on service menus or at the hotel.
(2) The hotel may change the terms and the changed terms shall go into force when they are published and notified publicly as provided under paragraph (1).
(3) Customers who use membership services may terminate their service contract by discontinuing their use of the services if they don’t agree with the terms. Continued use of services after the effective date of the terms shall be deemed to have received consent to the changes in the terms.

Article 3 (Rules other than terms)

When matters that are not specified in the terms are provided under the Framework Act on Telecommunications, the Telecommunications Business Act, and other relevant statutes, such provisions shall apply to the services.

Article 4 (Definition of terms)

The terms used in here shall be defined as follows:

(1) Member(s): Those who have concluded a service contract with the hotel or have been given an ID to use the services
(2) ID: A combination of letters and numbers determined by a member which the hotel approves to identify the member and his use of the services
(3) Password: A combination of letters and numbers determined by a member to authenticate that he is a member that match those with an ID and to protect their privacy
(4) Termination: Intention expressed by the hotel or members to terminate the service contract after the services are started

Chapter 2 Service Contract

Article 5 (Constitution of service contract)

The service contract is constituted when the hotel accepts a customer’s application for use of the services.

Article 6 (Application for use)

(1) The customer applies for the services by filling out all of the required information on the hotel-provided form.
(2) Adults ages 19 or older may apply for the services.
(3) All information the customer fills in the application form shall be deemed as true. Those who fail to fill in their real name or other personal information may not be protected by law and their services may be restricted.

Article 7 (Acceptance of applications for use)

(1) The hotel accepts applications for use by customers as provided under Article 6, except for those falling under subparagraphs 2 and 3.
(2) The hotel may hold its acceptance of an application for use until the cause for restricting the acceptance disappears in cases falling under the following:
a. When the capacity of service equipment is insufficient
b. When a technical obstacle exists
c. Other reasons as determined by the hotel [to hold acceptance]
(3) The hotel may refuse accepting applications for use in the below-listed cases:

a. The application is made using a third party name
b. False user information is indicated on the application form
c. The application is made with an intent to hurt social order or decent customs
d. Other application requirements presented by the hotel are not satisfied

Article 8 (Revision of user information)

The members shall revise or correct their updated personal information when the user information entered at the time of application has changed. The user shall exclusively be responsible for any problems that arise due to his failure to update the user information.
Chapter 3 Obligations of Contract Parties

Article 9 (Obligations of the hotel)

(1) The hotel shall not disclose or distribute the member’s personal information acquired in connection with the services without advance acceptance by the member, except in the below-listed cases:
a. When it is requested by the government pursuant to law, including the Framework Act on Telecommunications
b. When it is requested for investigation of crimes or by the Korea Communications Standards Commission
c. When it is requested based on procedures under other statutes
(2) Within the extent under paragraph (1), the hotel may prepare and utilize statistical data concerning all or part of the member’s personal information in connection with its services. The hotel may also transmit digital cookies to the member’s computer through the services. In such a case, the member may refuse receipt of such cookies or may reset his browser on his computer so that the cookie receipt may be warned.

Article 10 (Member obligations)

(1) The members shall not commit the below-listed acts while using the services:
a. Unauthorized or illegal use of a third-party ID
b. Using or providing to a third party information acquired while using the services for purposes other than use of the services without advance acceptance by the hotel, including copying, duplicating, modifying, translating, or using information for publishing or broadcasting
c. Acts of infringing copyrights or other rights of the hotel or third parties
d. Acts of disseminating information, logos or graphics that violate social order or decent customs
e. Acts designed to be criminal acts or objectively believed to be linked with crimes
f. Other acts violating relevant statutes
(2) The members shall comply with the provisions of the relevant statutes and these terms, information and admonitions concerning the services
(3) The members shall comply with service restrictions the hotel displays in service-related notices or a separate notification.
(4) The members shall not conduct any profit-seeking commercial activities using the services without advance acceptance by the hotel.

Chapter 4 Provision or Use of Services

Article 11 (Member obligations for ID and password safekeeping)

The members are exclusively responsible for the safekeeping of their ID and password. The members shall be exclusively responsible for all consequences arising out of negligent safekeeping or illegal use of the ID and password assigned to them.
The members shall immediately inform the hotel without failure when they discover their ID is used fraudulently or regarding any other security breaches.

Article 12 (Provision of services)

(1) The hotel may provide the users with diverse information concerning the services by e-mail, post or other diverse means during their use of the services when it is deemed necessary. The members may refuse receipt of such information in the menu for subscription or revision of member information.
(2) The hotel provides online community services and the members may participate in the services when they desire.

Article 13 (Transactions with advertisers)

The hotel shall not be held responsible for any loss or damage incurred as a result of the member’s participation in, communication or transaction with promotional activities of advertisers that are displayed on the services or provided through the services.

Article 14 (Member displayed articles)

The hotel shall not be held responsible for articles displayed, uploaded, or transmitted by the members by e-mail or otherwise. Articles that are believed to fall under any of the following may be deleted without advance notice:

(1) Contents that defame other members or third parties, infringe privacy, or damage reputation(s) through slander
(2) Articles or acts that obstruct or are feared to obstruct the stable operation of the services
(3) Content that is deemed to be related to criminal acts
(4) Content that infringes the intellectual property rights or other rights of the hotel and third parties
(5) Articles that are displayed over the period the hotel provides for display
(6) Other cases that are believed to breach relevant statutes

Article 15 (Rights or responsibilities for articles displayed)

The entire rights and responsibilities concerning an article and member displays, including copyrights, shall belong to the member who has displayed it.

Article 16 (Responsibility for use of services)

The members shall not use the services to sell illegal goods. In particular, they members shall not hack, advertise for profit seeking purposes, conduct commercial activities using obscene sites, or distribute illegal commercial software.
The hotel shall not be held responsible for the consequences of such actions, any losses for such illegal business activities, arrest or other legal actions taken by the authorities.

Article 17 (Restriction or suspension of services)

The hotel may restrict or suspend all or part of the services when a war, riot, natural disaster or other comparable national emergency has arisen or is feared as an outbreak, the backbone communication service providers under the Telecommunications Business Act, or another type of force majeure takes place. When the use of the services is restricted or suspended pursuant to paragraph (1), the hotel shall, without delay, inform the members of the cause and the period of restriction.

Chapter 5 Others

Article 18 (Termination of contract or restriction of use)

(1) To terminate the service contract, a member shall apply in person for termination with the hotel.
(2) The hotel may terminate the service contract or restrict use for a given period without advance notice when a member has committed any of the following:
a. Unauthorized use of a third party’s ID or password
b. Obstruction in the stable operation of the services
c. Intentional dissemination of content that hurts social order or decent customs
d. When a member plans or uses the services with purposes of damaging national or social benefits
e. Displaying or uploading or transmitting by e-mail or other means content that infringes intellectual property rights of a third party or defames others or causes disadvantages to others
f. Continuously transmitting contents that are obscene, vulgar or provocative, or advertising information or e-mails against the intention of the recipient
g. Disseminating computer virus programs that cause a malfunction or destruction of IT equipment
h. Infringing intellectual property rights of the hotel, other members or third parties
i. When the Korea Communications Standards Commission or other agencies demands a correction or when National Election Commission rules the act in connection with illegal campaigning
j. Unauthorized or illegal use of personal information, including a user ID or password belonging to others
k. Duplicating, distributing or exploiting for commercial purposes information obtained through the hotel’s services with advance approval by the hotel
l. Violation of statutes related to telecommunications
m. Violation of the service terms provided by the hotel, including these terms and relevant statutes

Article 19 (Compensation for damages)

The hotel shall not be held responsible for any damage inflicted on the members in connection with their use of the services while the services are provided free of charge.

Article 20 (Exemption)

(1) The hotel shall be exempted from failure to provide the services because of a natural disaster or other comparable force majeure.
(2) The hotel shall be exempted from failure in services due to causes attributable to the member.
(3) The hotel shall be exempted from the member’s loss of gains expected from his use of the services or damages caused by the member’s optional selection or use of service data.
(4) The hotel shall be exempted from the accuracy, reliability of information content, data or facts displayed on the service pages. The members use the services under their own responsibility and shall be exclusively responsible for damages suffered in connection with data displayed or transmitted while using the services or any disadvantages incurred in connection with their optional selection of the data or use of the services.
(5) The hotel shall not be held responsible for any trading of articles between members or members and third parties using the services as a medium. The hotel shall be exempted from gains the members expect from using the services.
(6) The members shall be exclusively responsible for damages caused by careless keeping or use of their ID or password or for any unauthorized use by third parties.

Article 21 (Court jurisdiction)

The law court with jurisdiction over the district where the hotel home office is located shall have exclusive jurisdiction for any lawsuits filed for disputes related to these terms.

[Addendum] (Enforcement date) These terms shall go into force on 10 February 2012.

(1) Items collected or used | Anniversaries, favorite hotels, hotel use purposes, the frequency of your using the Silla services a month (hotel/duty free shop), purposes of using hotel restaurants, monthly amount spent for dining out, favorite foods etc.
(2) Purpose of collection or use | Provision of information concerning products and services depending on customers’ anniversaries or preferences
(3) Period of possession or use | From the day collection or use consented to your withdrawal from membership
